Introduction
AtomWallets and/or its affiliates (“AtomWallets,” “we,” “our,” or “us”) provide non-custodial wallet software and related services through our website at atomwallets.com and our associated mobile applications (collectively, the “App” or “AtomWallets”).
These Terms of Service (the “Terms”) govern your access to and use of AtomWallets. By accessing or using the App, you agree to these Terms, including our Privacy Policy. If you do not agree, you must not use AtomWallets.
Important Disclaimer
AtomWallets does not provide investment, trading, legal, accounting, or tax advice. We only provide non-custodial software tools. You are solely responsible for any financial decisions, digital asset management, or tax obligations.
1. Acceptance of Terms
- By downloading, installing, or using AtomWallets, you confirm that you have read, understood, and agreed to these Terms.
- These Terms constitute a legally binding agreement between you and AtomWallets.
- If you are acting on behalf of an entity, you represent that you are authorized to bind that entity to these Terms.
2. Privacy Policy
Your privacy matters to us. Our (Privacy Policy) explains how we collect, use, and protect your personal information. By using AtomWallets, you consent to the collection and use of your information as outlined in our Privacy Policy.
3. Changes to Terms and Services
- AtomWallets reserves the right to update these Terms at any time. Changes will be effective upon posting to atomwallets.com or in-app notification.
- If material changes are made, we may provide additional notice. Continued use after changes means you accept the revised Terms.
- We may suspend, discontinue, or restrict parts of AtomWallets at any time without liability to you.
4. Eligibility and Compliance
4.1 You may use AtomWallets only if you:
- Are at least 18 years of age
- Have the legal capacity to enter into these Terms
- Are not located in, or a resident of, jurisdictions subject to sanctions or restrictions (including Cuba, Iran, North Korea, Syria, and certain regions of Ukraine)
- Are not listed on any restricted person lists (OFAC, EU, UK, UN, etc.)
- Use AtomWallets in compliance with applicable laws in your jurisdiction.
4.2 Compliance:
We may block access to users in restricted jurisdictions or as required by law.
5. Description of Services
AtomWallets provides a non-custodial software wallet, meaning:
- You control your private keys and digital assets at all times.
- AtomWallets does not hold, transfer, or recover your assets.
- We provide tools for storing, sending, receiving, and interacting with blockchain networks.
Features may include:
- Wallet creation and key management
- Token and NFT storage
- Decentralized application (DApp) browser
- Swaps and trades through integrated decentralized exchanges (DEXs)
- Staking and governance participation
- Third-party integrations (fiat onramps, marketplaces, DeFi protocols).
Transactions are irreversible once broadcast to a blockchain. AtomWallets cannot cancel, reverse, or refund transactions.
6. Wallet Credentials and Security
6.1 Your Responsibility:
You are solely responsible for securing your wallet credentials, including:
- Private keys
- Recovery/seed phrases
- Passwords or PINs.
Loss of your credentials will result in permanent loss of access to your assets. AtomWallets cannot restore or recover lost credentials.
6.2 You agree to:
- Maintain secure backups of your recovery phrase
- Never share your keys or passwords with others
- Notify us of any security vulnerabilities related to AtomWallets.
AtomWallets disclaims liability for losses arising from your failure to secure your credentials.
7. Third-Party Services and Content
7.1 Integrations:
AtomWallets may integrate or provide access to third-party services, including but not limited to:
- Decentralized exchanges (DEXs) for token swaps
- NFT marketplaces
- Staking or validator services
- Fiat-to-crypto payment processors.
7.2 Disclaimer:
Such services are operated by independent third parties. AtomWallets:
- Does not endorse or guarantee third-party services
- Is not responsible for their availability, accuracy, or reliability
- Is not liable for any losses, disputes, or fees arising from third-party services.
You must review and accept third-party terms before using their services.
8. Fees and Taxes
- Blockchain transactions require payment of network fees ("gas"). These fees are set by the blockchain and not controlled by AtomWallets.
- Third-party services may impose additional charges. These are your responsibility.
- AtomWallets does not control or refund blockchain or third-party fees.
- You are solely responsible for determining and paying any applicable taxes resulting from your digital asset activity.
9. Intellectual Property
- AtomWallets retains all intellectual property rights in the App and Services.
- Subject to these Terms, AtomWallets grants you a limited, non-exclusive, non-transferable, revocable license to use the App for personal or internal business purposes.
9.3 You may not:
- Copy, modify, or distribute the App
- Reverse engineer or attempt to extract source code
- Use AtomWallets branding without permission.
Feedback you provide may be used by us without restriction or obligation to compensate you.
10. Prohibited Activities
You agree not to use AtomWallets to:
- Violate any law, regulation, or third-party rights
- Engage in fraud, scams, or money laundering
- Finance terrorism or illegal activities
- Distribute malware or harmful content
- Overload, disrupt, or attack AtomWallets systems
- Impersonate others or misrepresent your identity.
We reserve the right to restrict access if you engage in prohibited conduct.
11. Disclaimer of Warranties
AtomWallets is provided "as is" and "as available" without warranties of any kind.
We do not guarantee that:
- The Services will be uninterrupted, secure, or error-free
- AtomWallets will meet your expectations
- Any information provided will be accurate, reliable, or timely.
You acknowledge that use of digital assets and blockchain technology involves inherent risks, including volatility, hacking, and regulatory changes.
12. Limitation of Liability
To the maximum extent permitted by law:
- AtomWallets is not liable for indirect, incidental, special, consequential, or punitive damages
- This includes loss of funds, data, profits, goodwill, or opportunities
- Our total liability to you will not exceed $100 USD.
13. Indemnification
You agree to indemnify, defend, and hold harmless AtomWallets, its affiliates, and their officers, directors, employees, and agents from any claims, damages, losses, or expenses arising out of:
- Your use of AtomWallets
- Your violation of these Terms
- Your violation of any applicable law or third-party rights.
14. Suspension and Termination
- We may suspend or terminate your access to AtomWallets at any time for any reason, including violations of these Terms or suspected illegal activity.
- Termination does not affect your continued access to your funds, provided you have your private keys and recovery phrase securely stored.
15. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of Hong Kong.
